LITTLE SNAPPERS Terms and Conditions (“Agreement”)

Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using www.littlesnappers.com.au (“the Site”) operated by LITTLE SNAPPERS HOLDINGS PTY. LTD. (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.littlesnappers.com.au

 

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.

 

Intellectual Property
The Site and its original content, features and functionality are owned by LITTLE SNAPPERS HOLDINGS PTY LTD. and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

 

Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Site may contain links to third-party sites that are not owned or controlled by LITTLE SNAPPERS HOLDINGS PTY LTD.

Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

 

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

SPECIAL EVENTS & COMPETITION T&C'S

PRECIOUS LOVES <3 MUMS & BUBS MORNING TEA

Participants must ensure that each child is accompanied by one parent or legal guardian throughout the event and are required to sign swim school waivers before entering the facility. Additionally, registration and RSVP must be completed beforehand to secure participation, and all attendees must adhere to the specified age requirements ranging from 6 months to 4 years old. It is important to note that the swim school reserves the right to deny registration to any participant at its discretion.

By attending the event, participants implicitly agree to adhere to these terms and conditions. Failure to comply may result in refusal of entry or participation. The swim school retains the right to modify these terms and conditions without prior notice. We appreciate your cooperation and look forward to celebrating the special bond between mother and child with you.

HOLIDAY INTENSIVE PROGRAMS

  1. Eligibility:

    • The holiday swim intensive program is open to children ages 3 years old and up.

    • Students must be emotionally ready to be in the pool without a parent or carer and be able to safely take instruction from a teacher.

    • Participation is subject to availability, and we reserve the right to decline admission if the class schedule does not accommodate additional students.

  2. Registration:

    • Parents or legal guardians must register their child for the program through our customer portal.

    • Registration is on a first-come, first-served basis, and spots are limited.

  3. Acceptance of Terms:

    • Prior to participation, parents or legal guardians must accept the terms and conditions of the swim school via the customer portal.

    • By enrolling their child in the holiday swim intensive program, participants agree to abide by these terms and conditions.

  4. Program Details:​

    • Specific details regarding the program schedule and curriculum will be provided upon registration.

  5. Attendance:

    • Participants are expected to attend all scheduled sessions of the program.

    • If a participant is unable to attend a session, it is their responsibility to notify the swim school in advance.

  6. Behavioral Expectations:

    • Participants are expected to behave in a respectful and cooperative manner during the program.

    • Disruptive behavior may result in removal from the program at the discretion of the swim school staff.

  7. Safety and Liability:

    • The safety of participants is of utmost importance, and all activities will be conducted in accordance with relevant safety guidelines.

    • Parents or legal guardians are responsible for ensuring that their child is physically and mentally fit to participate in the program.

    • The swim school will not be liable for any injuries or accidents that occur during the program, except in cases of negligence on the part of the swim school.

  8. Modification or Cancellation:

    • The swim school reserves the right to modify or cancel the holiday swim intensive program at any time, with or without prior notice.

By enrolling their child in the holiday swim intensive program, parents or legal guardians acknowledge that they have read, understood, and agreed to these terms and conditions.

SWIM SCHOOL POLICIES, TERMS & CONDITIONS

We ask that all clients of Little Snappers Swim School become familiar with our policies as they are in place to help provide the best possible service to all our families. As we are a boutique aquatic centre specialising in small class sizes in purpose-built facilities, the following allow us to provide excellence in teaching and amenities at an affordable price.

 

PAYMENT POLICY

We bill you fortnightly in advance. Fees are due on the Thursday prior to the fortnight dates being charged. All accounts must have a current debit or credit card on file in their customer portal. To avoid being charged automatically for your fortnightly fees, you are welcome to make an advance payment over the counter or through the customer portal.

Accounts must be current to be eligible for makeup classes. An account representative will contact you if your account is not up to date. Unpaid accounts are subject to cancellation.

Stored payment details are a condition of your booking. You are always welcome to pay in advance at reception to avoid payment processing on your stored card.

If you need assistance on setting this up please contact reception. You can also set up your payment details in person at reception or over the phone by calling our admin team.

MAKEUP LESSON POLICY

We are pleased to offer limited makeup lessons under specific terms and conditions. Please keep in mind the following:

 

Learning is most effective with consistency, and changing lesson schedules can sometimes disrupt both your child's progress and the class environment. Our 40 years of experience show that makeup lessons, while sometimes necessary, can be less beneficial for the learning process. We ask that you consider the impact on your child’s learning and the progress of other children when scheduling makeups. Consistent attendance is the key to success for all students.

 

Makeup Lesson Terms:

  • 24 hours’ notice is required to be eligible for a makeup token.

  • Parents must log their intended absence in the Parent Portal.

  • Once a makeup token is issued, you can book your makeup lesson via the Parent Portal.

  • Makeup lessons are subject to availability.

  • Makeup tokens expire after 90 days.

  • Tokens are a courtesy service, not redeemable for cash or credit, and can only be used with an active, paid booking.

  • Our team is available to assist with the Parent Portal on handheld devices if needed.

  • We highly recommend using makeup lessons sparingly to support your child’s learning progress.

 

Private/Semi-Private Lessons:

  • Makeup tokens are not available for private/semi-private lessons. Instead, these lessons must be canceled with 48 hours’ notice.

  • Cancellations with less than 48 hours’ notice will incur a $30 cancellation fee.

 

Additional Terms & Conditions:

  • All makeup lessons must be booked by the client in the Parent Portal. Our team is happy to assist with this process if you encounter any issues.

  • Makeup tokens must be used within 90 days. Unused tokens will be forfeited, and there is no monetary value associated with them.

  • Clients cannot use tokens unless they have a current, paid booking, and all accounts must be in good standing.

  • Excessive use of makeup lessons can disrupt the learning environment, so we encourage minimal use to maintain progress for all students.

  • Regularly scheduled bookings will always take priority over makeup bookings.

  • In cases of extenuating circumstances, please contact us, and we will do our best to accommodate you.

 

We appreciate your understanding and cooperation as we strive to maintain a productive and supportive learning environment for all students.

 

PUBLIC HOLIDAYS

As our facilities maintain the same level of expenses on a Public Holiday including staff wages, if your weekly lesson falls on a Public Holiday, you will be charged as normal and allocated a makeup token. You are also able to book into any of our normal weekly classes.

 

CANCELLATION & REFUND POLICY 

You can cancel your lessons with us at any time via the Customer Portal. We require 2 week’s notice and we will prorate and refund any credits you have. Use the Customer Portal to notify us of your exit from the program. Makeup tokens are not to be used in lieu of your 2-week notice. Staff are available to show you on your device how to do this.

Please note: You are responsible for payment for your student's classes WHETHER OR NOT YOUR STUDENT ATTENDS CLASS until the time you use the customer portal to exit the program.

Refund Policy for New Students' First Lesson

We aim to provide a positive experience for all our students. To ensure clarity and fairness, please review our refund policy for new students attending their first swimming lesson:

  1. Eligibility for Refund:

    • New students are eligible for a refund of their first lesson fee under the following conditions:

      • The student must attend the first lesson.

      • The student or their guardian must notify our management on the same day as the first lesson of their intention to discontinue and request a refund.

  2. Refund Process:

    • Requests for refunds must be made in writing and submitted on the day of the first lesson. Notifications made after the first lesson date will not be eligible for a refund.

    • Refunds will be processed using the same payment method originally used for the transaction.

  3. Exclusions:

    • Government-issued vouchers or credits are not eligible for a refund. These are subject to the terms and conditions set by the issuing department or authority.

  4. Legal Compliance:

    • This policy is in accordance with Australian Consumer Law and applicable Queensland legislation. If you have any concerns or require further clarification, please contact us or refer to the Australian Competition and Consumer Commission (ACCC) guidelines for more information.

By enrolling in our swimming lessons, you agree to the terms outlined in this policy. We appreciate your understanding and cooperation.

FORTNIGHTLY SWIMMING POLICY

Unfortunately, we do not offer fortnightly lessons. We understand this can be challenging for our families with split care or work schedules that do not accommodate weekly committed lessons. Many of our fortnightly families have confirmed weekly classes and use makeup tokens to reschedule the classes they are unable to attend. Makeup tokens are subject to our terms and conditions and are not guaranteed should there be no space in the schedule to accomodate.

 

WHAT TO WEAR

SWIM NAPPY - All children under 3 must wear a swim nappy. Please also wear another set of swimmers over the top as a double layer of protection. Warm water combined with exercise stimulates young children’s bowels. If an accident occurs the pool is at risk of being evacuated and classes canceled for the remainder of the day. We appreciate your understanding. We recommend reusable nappies as the disposable ones shed fluff which put excess strain on our filtration.

All children 3 years and older are recommended to wear tight fitting swimwear with lycra. Loose fitting clothing in water is not ideal for learning how to swim.

 

CAPS & GOGGLES - It is a requirement to wear caps and goggles as part of the health and upkeep of our water quality as well as improving the learning of skills in the water. Caps and goggles can be purchased at reception.

PHOTOGRAPHY - If you wish to photograph or video your child’s lessons, you must get permission from all the parents of the children in the class and complete and sign a form at reception. Little Snappers may take photos of classes from time to time. Please advise if you wish for your photo to not be used by Little Snappers.

MAY 2024 GIVEAWAY

  1. Eligibility:

    • Participants must be legal residents of Queensland, Australia.

    • Employees, affiliates, and immediate family members of Little Snappers Swim Schools are not eligible to participate.

    • Three winners will be selected randomly.

    • Each winner will receive three months of swimming lessons for one child and a gift bag of swimming accessories.

    • Winners can choose from four available locations in Queensland to redeem their swimming lessons.

    • The prize holds no cash value and cannot be transferred or exchanged.

  4. Winner Selection:

    • Winners will be randomly drawn and announced by midnight on  May 15, 2024.

    • The company will notify winners via the contact information provided during entry.

    • If a winner cannot be contacted or does not respond within seven days, an alternate winner may be selected.

  5. Redemption:

    • Winners must redeem their prizes within 30 days of notification.

    • Failure to redeem the prize within the specified timeframe may result in forfeiture.

    • To secure their place, winners must provide a valid credit card or debit card to be kept on file with the swim school.

    • Winners must also agree to abide by the terms and conditions of the swim school.

    • Upon the completion of the three-month prize period, winners will not be automatically removed from the program but will continue as regular clients.

    • Following the conclusion of the prize period, winners' credit cards on file will be charged for lessons as per the swim school's regular fee structure.

    • If winners wish to discontinue lessons at the end of the prize period, they must provide a two-week cancellation notice, failing which their card on file may be charged.

    • All clients of the swim school are required to pay their swim fees two weeks in advance at all times.

  6. General Terms:

    • By participating in the giveaway, participants agree to abide by these terms and conditions.

    • The company reserves the right to disqualify any participant found to be in violation of these terms.

    • The company may modify or cancel the giveaway at any time without prior notice, in accordance with Queensland regulations.

    • Any disputes arising from the giveaway will be subject to the laws of Queensland, Australia.

By entering the giveaway, participants acknowledge that they have read, understood, and agreed to these terms and conditions.

WINTER SPECIAL PROMO - DISCOUNTED SECOND LESSON

  1. Winter Promo runs between May and July and can commence at any time in this period.

  2. Client must pay full price for the first lesson to receive the second lesson at the promo stated price.

  3. Client account must be paid in full and in good standing.

  4. Second lesson stays booked after the promo period ends July 30th and will revert to full price. It is the responsibility of the client to drop the 2nd lesson with 2 weeks notice as per terms and conditions.

  5. Second lesson not eligible for makeup lessons.

  6. Promo price is applied to client accounts on request only. If you are already receiving a 2nd lesson your price will stay the same unless you request the promo price. 

  7. You must commit the second lesson at the promo price for the length of the Winter period.

SPECIAL LESSON PRICE PROMOS - FOUR FOR FORTY OR FIVE FOR FIFTY OR SIX FOR SIXTY etc.

  1. The Special Lesson Price Promo is defined as any promo offered where a set number of lessons are offered for $10 per lesson

  2. Client must pay in advance upon booking for the entire promo. For example if the promo is Five lessons for Fifty Dollars - the client must pay in full the $50 upon booking.

  3. Booking is subject to the same terms and conditions as regular bookings including client portal setup, waivers, billing information on file.

  4. There are no makeup lessons on promo priced lessons.

  5. Once the promo is over the client booking automatically rolls over into a full price booking. 

  6. Client is responsible for cancelling the booking should they wish to not continue lessons after the promo ends. 

  7. Cancellation notice period is 2 weeks in advance as per the terms and conditions.

  8. New clients will receive the promo price on their first weekly lessons. Existing clients can take advantage of the promo price by adding a 2nd weekly lesson.

  9. Promo dates vary and are subject to cancellation by Little Snappers at any time.
